In case of not following the instructions correctly, EiSIM By: Social Fi Cellular Network will not have any responsibility for the purchase. When you choose to acquire any of the EiSIM Web Native “Widget” and Data Services from the Website and/or the EiSIM Web Native “Widget”, those services or products are subject to the fees and terms of the third party. You are obliged to pay the costs that are established for the EiSIM Web Native “Widget” and Data Services and to cancel it in case the services are hired by a recurring fee from time to time that is charged to a credit card, and there are not required. If you do not cancel the said subscription, the charges will continue to be made, whether you use the purchased Services or not. The data packages will have the term and/or GB amount established at the time of purchase depending on your interests, and once the contracted time has elapsed or the GB have been exhausted you will have to purchase another package to continue with the Services. In case you purchased a package by a recurring fee from time to time, the subscription will be automatically renewed for equal periods, unless you cancel the subscription or change your subscription plan. Once a package is purchased, there will be no refunds or partial refunds. There is no limit of Devices to access to an Account, however, the media and the purchased data can only be used on one device at a time. CANCELLATIONS If you selected a recurring fee package and fail to meet your payment obligations on the due date, EiSIM By: Social Fi Cellular Network will automatically cancel the hired services. Your service will not resume until you pay the outstanding amount in full. In case of non-payment, EiSIM’s services will be completely suspended. You will not be able to cancel or change your subscription until the term of the subscription has expired. The cancellation or change will be activated after the end of the hired period, depending on the subscription plan or package. You can cancel your subscription by email, you will receive an email as confirmation of the effective cancellation, in case of not receiving such email, you may indicate that the cancellation was not effectively done, and the charge may continue to be made. After the cancellation you will not receive any more services from EiSIM By: Social Fi Cellular Network or the Provider. 7. CONNECTION RULES AND CONTENT To use the Website and/or Web Native “Widget” EiSIM Web Native “Widget”, you must always have to be connected to high-speed internet, (for which EiSIM By: Social Fi Cellular Network offers EiSIM’s EiSIM Web Native “Widget” and Data Services) and have a device that is compatible with EiSIM’s Services, otherwise data plans information, programs, content and other services will not load properly; the quality of content may vary depending on the device, configuration and network quality. Also, if your device is disconnected from the Internet, you will not be able to use all features related to the Website and/or Web Native “Widget” EiSIM Web Native “Widget”, and will not be able to purchase a data package for such reason, nor be able to have access to the different data plans offered in the Website and/or Web Native “Widget” EiSIM Web Native “Widget”. EiSIM By: Social Fi Cellular Network assumes no responsibility for malfunctions caused by misuse or mishandling of the Website and/or Web Native “Widget” EiSIM Web Native “Widget”. Software. Our Services may allow you to download software, such as mobile applications, which may update automatically to ensure you’re using the latest version. Our software may include open source software that is governed by its own licenses that we’ve made available to you. Corporate domains. If you create an account using an email address owned by an organization (for example, your employer), that account may be added to the organization's business account with us, in which case we will provide notice to you so that you can help facilitate the transfer of your account (unless your organization has already provided notice to you that it may monitor and control your account). Once your account is transferred, the organization’s administrator will be able to control your account, including being able to access Content (defined below) and restrict or remove your access to the account. Paid accounts Billing. If you purchase any Services, you will provide complete and accurate billing information, including a valid payment method. For paid subscriptions, we will automatically charge your payment method on each agreed-upon periodic renewal until you cancel. You’re responsible for all applicable taxes, and we’ll charge tax when required. If your payment cannot be completed, we may downgrade your account or suspend your access to our Services until payment is received. Service credits. Termination and suspension Termination. You are free to stop using our Services at any time. You and “AI” EiSIM By: Social Fi Cellular Network agree to resolve any claims arising out of or relating to these Terms or our Services, regardless of when the claim arose, even if it was before these Terms existed (a “Dispute”), through final and binding arbitration. You may opt out of arbitration within 30 days of account creation or of any updates to these arbitration terms within 30 days after the update has taken effect by EMAIL INF0 AT SOCIAL-FI DOT NET . If you opt out of an update, the last set of agreed upon arbitration terms will apply. Informal dispute resolution. We would like to understand and try to address your concerns prior to formal legal action. Before either of us files a claim against the other, we both agree to try to resolve the Dispute informally. If we are unable to resolve a Dispute within 60 days, either of us has the right to initiate arbitration. We also both agree to attend an individual settlement conference if either party requests one during this time. Any statute of limitations will be tolled during this informal resolution process. The activities described in these Terms involve interstate commerce and the Federal Arbitration Act will govern the interpretation and enforcement of these arbitration terms and any arbitration. Arbitration procedures. The arbitration will be conducted by videoconference if possible, but if the arbitrator determines a hearing should be conducted in person, the location will be mutually agreed upon, in the county where you reside, or as determined by the arbitrator, unless the batch arbitration process applies. The arbitration will be conducted by a sole arbitrator. The arbitrator will be either a retired judge or an attorney licensed to practice law in the state of Louisiana. The arbitrator will have exclusive authority to resolve any Dispute, except the state or federal courts of San Francisco, Louisiana have the authority to determine any Dispute about enforceability, validity of the class action waiver, or requests for public injunctive relief, as set out below. Any settlement offer amounts will not be disclosed to the arbitrator by either party until after the arbitrator determines the final award, if any. The parties agree to sever and litigate in court any request for public injunctive relief after completing arbitration for the underlying claim and all other claims. You and “AI” EiSIM By: Social Fi Cellular Network knowingly and irrevocably waive any right to trial by jury in any action, proceeding, or counterclaim. Batch arbitration. If 25 or more claimants represented by the same or similar counsel file demands for arbitration raising substantially similar Disputes within 90 days of each other, then you and “AI” EiSIM By: Social Fi Cellular Network agree that NAM will administer them in batches of up to 50 claimants each (“Batch”), unless there are less than 50 claimants in total or after batching, which will comprise a single Batch. NAM will administer each Batch as a single consolidated arbitration with one arbitrator, one set of arbitration fees, and one hearing held by videoconference or in a location decided by the arbitrator for each Batch. If any part of this section is found to be invalid or unenforceable as to a particular claimant or Batch, it will be severed and arbitrated in individual proceedings. Severability. If any part of these arbitration terms is found to be illegal or unenforceable, the remainder will remain in effect, except that if a finding of partial illegality or unenforceability would allow class arbitration, class action, or representative action, this entire dispute resolution section will be unenforceable in its entirety.
